# Terms and Conditions

These terms apply to every offer we make and every order placed through eaudd.com.
Please read them before ordering. Nothing in them limits the rights Dutch consumer
law gives you; where a term conflicts with a mandatory legal right, that legal right
prevails.

## 1. Who you are contracting with

## 2. Our products

We describe each fragrance as accurately as we can, including its notes, concentration
and volume. Photographs are intended to represent the product faithfully, but screens
vary and packaging is occasionally updated, so small differences in colour or presentation
are possible and are not a defect.

## 3. Prices

Prices are shown in euros and include Dutch VAT. Shipping costs, where they apply,
are shown before you confirm the order. A price is valid while it is displayed; 
obvious typographical errors do not bind us, and if one occurs we will tell you 
and let you confirm or cancel the order.

## 4. How the contract is formed

Placing an order is an offer to buy. The contract comes into being when we send 
you an order confirmation by email. If we cannot accept an order — for example because
an item is out of stock — we will tell you promptly and refund any payment in full.

## 5. Payment

Payment is taken at checkout through our payment service provider, using the methods
shown there. We do not see or store your full card details.

## 6. Delivery

We ship within the Netherlands free of charge. Where a delivery charge applies to
another destination, it is shown before you confirm the order. We aim to dispatch
promptly and, unless we have agreed otherwise with you, we will deliver within 30
days of the contract at the latest. If we cannot, you may set a reasonable further
period and, if we still fail, cancel the order and receive a full refund. Risk of
damage or loss passes to you when the goods are handed to you or to a carrier you
appointed yourself.

## 7. Your right to cancel

As a consumer you may cancel within 14 days of receiving the goods, without giving
a reason. How to do it, what condition goods must be in, who pays return postage,
and the exceptions that apply are all set out on our Returns and Refunds page, which
forms part of these terms.

## 8. Fragrances that cannot be returned

Perfume is a sealed good supplied with a hygiene seal. Under Article 6:230p of the
Dutch Civil Code, a sealed product that is not suitable for return for reasons of
health protection or hygiene is excluded from the right of withdrawal once it has
been unsealed. In practice this means an unopened bottle may be returned; an opened
one may not.

## 9. Conformity

Everything we sell must correspond to the contract and be of the quality you may
reasonably expect. If it does not, you have the remedies Dutch law gives you, including
repair, replacement, a price reduction or cancellation. This legal guarantee is 
free of charge and is not limited in time by these terms.

## 10. Complaints

If something is wrong, write to **info@eaudd.com** describing the problem. We will
acknowledge within 14 days and, if we need longer to investigate, tell you when 
to expect a full answer. Raising a complaint does not suspend your legal rights.

## 11. Liability

We are liable for damage caused by our own intent or gross negligence, for death
or personal injury, and wherever Dutch law does not permit liability to be limited.
Beyond that, our liability for any order is limited to the amount you paid for it.
We are not liable for indirect or consequential loss.

## 12. Events outside our control

We are not in breach of these terms if we are prevented from performing by something
genuinely outside our control, such as a carrier strike, extreme weather or a failure
of a supplier we could not reasonably have foreseen. If such an event lasts more
than 30 days, either of us may cancel the affected order and we will refund you 
in full.

## 13. Governing law

Dutch law applies. Disputes may be brought before the competent court in the Netherlands.
As a consumer, you keep the protection of any mandatory rules of the country in 
which you live, and you may also bring proceedings in the courts of that country.

## 14. Changes to these terms

We may update these terms. The version published when you place your order is the
one that governs it.
